Modification Application

What Can Be Modified?


Any modification to your Unit or your Limited Common Area requires pre-approval by the Board of Directors.  Examples of modifications that may be permissible might include planting or removing trees or shrubs, paving or resurfacing your driveway, replacing windows, changing or modifying your parking area, installing a handicap access ramp, hanging rain gutters, painting the outside of your unit a different color, installing a fence or substantial plant barrier, making changes to your unit's deck or patio, installing outside generators or fuel tanks, or making any changes to the appearance or function of the outside of your Unit or Limited Common Area.  


Any change to the Common Area requires Board approval.  


  • Note that any permitted modification shifts the responsibility for its maintenance, along with the correction or restitution for any unforeseen damage that may result, to the present unit owner and to any future owner of that unit.  It is the responsibility of the owner to notify future owners of this.  The Association will not be responsible for the maintenance of any modification, and should any be required, the current unit owner will be billed.   


State Law and our Association's Instruments strictly forbid many modifications. 


State of New Hampshire RSA 356-B:30 Alterations Within Units. –
I. Except to the extent prohibited by the condominium instruments, and subject to any restrictions and limitations specified therein, any unit owner may make any improvements or alterations within his unit that do not impair the structural integrity of any structure or otherwise lessen the support of any portion of the condominium. But no unit owner shall do anything which would change the exterior appearance of his unit or of any other portion of the condominium except to such extent and subject to such conditions as the condominium instruments may specify.

ARTICLE VI: PROHIBITION AGAINST STRUCTURAL CHANGES BY OWNER 


6-100 No owner shall, without first satisfying the requirements regarding repair or other work set forth in Article 5 above, and, in addition, obtaining the written consent of the Board; 


  • 6-101 Make or permit to be made any structural alteration, improvement, or addition in or to his condominium unit, garage, or in or to any other part of The Condominium; 
  • 6-102  Tamper with any bearing wall or take any action or permit any action to be taken that will impair the structural soundness or integrity or safety of the Building or any other structure in The Condominium; 
  • 6-103  Impair any easement or right or personal property which is a part of The Condominium; 
  • 6-104 Paint or decorate any portion of the exterior of the Building or any other structure in The Condominium or any Common Area therein. 
  • 6-105  No structural additions shall be permitted to the exterior of the individual Units within the Limited Common Area without the approval of two-thirds (2/3) or more of the total voting power of all Unit owners. Any such structural addition requires a fee group increase for the Unit involved. Any such structural addition must be located totally within the Limited Common Area appurtenant to the Owner's Unit. No construction is to begin prior to receiving the required approval. No internal modifications of individual Units which would increase the number of presently existing bedrooms shall be permitted. Additions constructed under this amendment shall not expand the boundaries of the Limited Common Area. Structural alterations which do not increase the individual unit
